These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the website elqovent.com and the services offered by Elqovent S.A. (hereinafter, "Elqovent"), a company incorporated under the laws of the Argentine Republic, registered with the General Inspection of Justice under No. 1847265, with CUIT 30-71825943-2 and legal domicile at Av. Corrientes 1234, Floor 8, Office B, C1043AAZ, Ciudad Autónoma de Buenos Aires, Argentina.
1. Acceptance of Terms
By accessing or using our website and services, you declare that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you disagree with any provision, we ask that you do not use our services.
2. Description of service
Elqovent operates a digital real estate crowdlending platform that allows users to collectively participate in the financing of construction projects, urban development, and property renovation in Argentina. The platform acts as an intermediary between investors and real estate project promoters, facilitating the collective investment process in accordance with current regulations.
3. Registration and user account
To access investment services, you must create an account providing truthful, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and all activities carried out from your account. Elqovent reserves the right to verify your identity in accordance with UIF (Financial Information Unit) regulations regarding the prevention of money laundering and terrorist financing. The account is personal and non-transferable.
4. Investments and risks
Investments made through the platform carry risks inherent to the real estate market and crowdlending activity. Past returns do not guarantee future returns. Invested capital may be subject to partial or total losses. Elqovent does not guarantee profitability or return of invested capital. Before investing, we recommend carefully evaluating your financial situation, risk tolerance, and consulting with an independent financial advisor if necessary. The information provided on the platform about projects is for informational purposes and does not constitute financial advice or an investment recommendation.
5. User obligations
The user agrees to: use the platform in accordance with the law, morality, and public order; provide truthful information and keep it updated; not use the platform for illicit or unauthorized purposes; not attempt to access restricted areas of the system; not reproduce, distribute, or modify the platform's content without express authorization; and comply with all tax obligations arising from investments made through the platform.
6. Intellectual property
All content on the website, including but not limited to texts, graphics, logos, icons, images, software, designs, and data compilations, is the property of Elqovent S.A. or its licensors and is protected by Argentine and international intellectual property laws, including Law 11,723 on Intellectual Property. Total or partial reproduction without express authorization is prohibited.
7. Limitation of liability
Elqovent shall not be liable for: indirect, incidental, special, or consequential damages arising from the use of the platform; service interruptions due to force majeure, maintenance, or technical issues; the conduct of third parties, including project promoters; investment losses resulting from real estate market or economic factors; or information provided by third parties about projects published on the platform. Elqovent's total liability shall be limited to the amount of commissions actually received for services provided to the user.
8. Data protection
The processing of your personal data is governed by our Privacy Policy and by Law 25,326 on Personal Data Protection. By using our services, you consent to the processing of your data in accordance with said policy.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic. For any dispute arising from these Terms or from the use of the platform, the parties submit to the exclusive jurisdiction of the Ordinary Commercial Courts of the Ciudad Autónoma de Buenos Aires, waiving any other forum or jurisdiction that may correspond to them.
10. Modifications
Elqovent reserves the right to modify these Terms at any time. Changes will be notified to registered users by email and published on the website at least 15 days before they take effect. Continued use of the platform after notification implies acceptance of the modified Terms.
